Website and App Terms of Use

These terms govern use of the Studio's website, its app and their account areas; classes and purchases follow the document you accept for them.

1. What these terms cover

These terms govern use of the Studio's website (www.artstudiopalette.com), its Android and iOS app and their account areas. Classes, memberships, summer programs, workshops, parties and gift certificates are governed by the document you accept for them: the Enrollment Agreement with its Schedule A (annual program, trial classes and summer classes), the Workshop Cancellation and Refund Policy, or the Gift Certificate Terms. Each is shown before the commitment and linked in section 12; if it and these terms differ, that document wins. These terms add no cancellation, refund, expiration or waiver rule of their own. The Privacy Policy explains how information is handled.

2. Website information

Public pages describe the Studio's programs and services. Schedules, availability, instructors, locations and prices may change until an enrollment or purchase is confirmed. Website content alone does not reserve a seat or create a payment obligation.

3. Accounts

3.1 Accounts are held only by adults: a parent or legal guardian, or a student aged 18 or older by the America/Los_Angeles calendar date. A student under 18 has no login; their records and portfolio sit in their parent's or guardian's family account.

3.2 One person uses one login. The account holder is responsible for keeping the password private, for the accuracy of the information they enter, including a child's health and safety information, and for telling us at once about unauthorized access.

3.3 The Studio may suspend access when reasonably necessary to protect accounts, students, financial records or the service, and tells the holder why.

3.4 A commenter sign-in (a studio account, Google, a one-time email code or, once enabled, Facebook) only lets an adult comment on gallery works under section 4; it opens no family account and no student records.

4. Acceptable use

Do not attempt to access another person's records, bypass security, disrupt the service, upload malicious material, scrape or download other students' images, send abusive messages or use the website or app unlawfully.

Comments on gallery works are open to people aged 18 or older who confirm it when they first comment. Keep comments about the artwork and respectful. Do not post personal information about any student or family (full names, schools, addresses, schedules), advertising, links to unrelated sites, or material you have no right to post. Comments appear at once; an administrator may remove any comment without notice and may reply as the Studio; repeated misuse ends commenting access. You are responsible for what you post and allow the Studio to display it with the name from your sign-in until you delete it or ask us to.

5. Enrollment and payments

Submitting a form or a payment attempt does not by itself confirm enrollment or payment. Card, Cash App Pay and ACH bank payments are processed by Square. A payment shows as Paid after a verified provider notification, or after an administrator records a payment made outside the website with its date and amount. Prices, refunds, withdrawal and makeups follow the document accepted for that program.

6. Text messages

Sender: Studio Palette Arts & Crafts. We offer two optional SMS programs: SMS class reminders (about 2 messages per class, about 24 hours and 2 hours before it) and event and promotional messages (events and offers, about 1 to 4 messages a month). Each needs your separate opt-in and is never a condition of enrollment or purchase. Message and data rates may apply. Reply STOP to any message to stop all texts to that number and HELP for help, or email contact@artstudiopalette.com. Carriers are not liable for delayed or undelivered messages. We text a number only after its holder opts in; an urgent notice about a cancelled class or an emergency may also be sent to the phone you listed for that purpose in your Enrollment Information. How numbers are handled is described in the Privacy Policy.

7. Electronic acceptance and notices

Accepting a document in your account, or completing a checkout that presents it, is your signature under the California Uniform Electronic Transactions Act; we keep a record of who accepted, the version, the time, each checkbox and the IP address and browser used, and keep the accepted document in your account, where you can open and download it. Email, text and in-account notices are electronic records you agree to receive. You may ask for a paper copy or sign on paper instead. Notices from the Studio go to the email on file and to your account; notices to the Studio go to contact@artstudiopalette.com. In an emergency call 911, then +1 (916) 707-7037.

8. Content and intellectual property

The Studio's site design, text, branding and studio-owned media may not be copied or commercially reused without permission. A student keeps the copyright in their artwork. Student images and artwork are shown publicly only under the applicable Media Consent; public display transfers no ownership and gives no one else the right to reuse them.

9. Service availability and liability for the website

We work to keep the website and app accurate and available, but maintenance, provider outages or security events may limit access, and protected account records remain authoritative when a page is unavailable. To the extent California law allows, the Studio is not liable for loss caused by unavailability or errors of the website or app itself. Nothing here limits the Studio's responsibility for classes, personal injury, or anything the Enrollment Agreement or the law does not allow to be limited.

10. Governing law

California law governs; either side may bring a claim in the court the law provides. There is no arbitration clause, jury waiver or class-action waiver.

11. Changes

Material changes to these terms are announced by email to current families and in your account at least 30 days before they take effect; other changes are posted with a new date at the top. Program commitments you have already accepted are never replaced by a website edit.
